The fight between One Hundred Label and IST Entertainment continues over the trademark rights to The Boyz name.
Boy group The Boyz are set to move agencies from IST to One Hundred Label this month. Their contract with IST ends on December 5th.
On the 5th, One Hundred Label released a statement that the majority of the conditions that IST sent to them were disadvantageous to the boy group, claiming that IST’s previous claims that they had provided free use of The Boyz name to the members was false.
The alleged list of three stipulations provided to One Hundred Label by IST was leaked to media outlet TenAsia late night Wednesday.
Firstly, IST would continue to retain 56 trademark rights, according to the document. In the case that the 11 members of The Boyz decide to continue promoting under that name, IST would allow the group to do so free of charge. If the clauses in their agreements were kept, then the group could renew the usage of their name with IST in one year intervals. A clause was added forbidding the remaster or remake of records or contents owned by IST. Concerning the aforementioned conditions, The Boyz would be required in perpetuity to either obtain permission from IST or pay them for usage.
Second, IST requested that they be allowed to continue selling the merchandise in their possession. The total amount of inventory amounted to billions of KRW (millions of dollars).
The last stipulation stressed that all negotiations and agreements were to be kept confidential, and that any interactions with the media regarding the trademark rights were subject to approval by IST’s CEO.
It was uncertain whether The Boyz would be able to retain the rights to their group name. According to a report by Newsen, One Hundred Label was preparing for a breakdown of negotiations and had submitted requests for the trademarks to “The Boyz”, “The New Boyz”, and “TNBZ”, among others.
One Hundred Label assured fans that they would try their best to negotiate with IST. Many wondered whether The Boyz would be able to keep their name, or if they would debut under a new one in a move reminiscent of the boy group Highlight, formerly known as Beast.
